Man sues Jersey Mike’s & Grubhub after delivery driver’s teeth found in sandwich

A man is suing Jersey Mike’s, Grubhub, and a delivery driver after the driver’s dentures were found in his order. Seriously.

Even though food delivery apps have become a part of everyday life, ordering something from a restaurant or store is still fraught with danger. Missing items are pretty common, you might end up with cold food if they take too long, or worse still, they may not deliver it altogether.

There have been some extreme cases, too, where customers have received their order and been disgusted by what is actually inside or by the behavior of the delivery drivers. This has led to a number of high-profile lawsuits across the United States.

In the case of New Jersey-based Fernando Rodriguez, he ordered a cheesesteak sandwich from Jersey Mike’s back in April 2025 and ended up finding his delivery driver’s teeth wrapped inside his order.

According to the New York Post, Rodriguez is suing the sandwich restaurant, Grubhub, and Theresa Gildea – the delivery driver in question – on a few different counts. 

As per court documents, seen by the Post, Rodriguez “experienced extreme shock, disgust, emotional distress, nausea, loss of appetite, and physical revulsion” after finding the teeth “embedded within the sandwich.”

Rodriguez’s suit accuses Gildea of “tampering” with his food and Jersey Mike’s for failing to “properly package, seal, and secure food.” Grubhub is being accused of negligent training and hiring of their delivery drivers.

The food delivery app told the Post that Gildea is “no longer contracted to deliver” with them and they were “troubled” by the allegations. 

Local police were also involved, questioning the driver and Jersey Mike’s franchisee over the order.

Some customers have admitted to using AI to make their orders look worse than they are, just so they get a refund. Yet, that doesn’t appear to be the case for Rodriguez.

One of Grubhub’s rivals, DoorDash, has also banned drivers for using AI to fake deliveries in order to keep the food for themselves.
